This Privacy Policy explains how Trukren Logistics Ltd. collects, uses, discloses, and protects personal information in connection with the Trukren mobile platform. It applies to all users including Carriers, Shippers, and Sub-Users. Trukren is committed to protecting privacy in accordance with applicable Canadian privacy legislation, including PIPEDA and PIPA (British Columbia).
1. Who This Policy Applies To
This single Privacy Policy applies to all categories of Platform users:
- Carriers — fleet owners and the businesses they represent.
- Shippers — businesses that post and manage load orders.
- Sub-Users — drivers, owner administrators, and dispatchers who operate under a Carrier's or Shipper's account.
Where this policy refers to "you", it refers to the relevant individual or business whose personal information is being collected or processed.
2. Information We Collect
2.1 Account and Business Information
When a Carrier or Shipper registers, we collect information such as first and last name, email address, password (stored in encrypted form), company name, business address, province, and contact details.
2.2 Operational and Sub-User Information
In the course of using the Platform, Carriers and Shippers may submit additional information, including:
- Driver details, including driver licence information.
- Vehicle and equipment information.
- Insurance and liability documentation.
- Order and load information, including pickup and delivery addresses, load descriptions, weights, dimensions, and special handling requirements.
- Sub-User contact details and role assignments.
2.3 Information Collected Automatically
When you use the Platform, we may automatically collect device type, operating system, app version, IP address, log data, and usage activity.
2.4 Consent Records
We collect and retain records of your acceptance of our Terms and Conditions and this Privacy Policy, including the date, time, and version accepted.
3. How We Collect Information
We collect personal information in the following ways:
- Directly from you when you register, complete your profile, or submit information through the Platform.
- From Carriers and Shippers about their Sub-Users.
- Automatically through your use of the Platform, as described in Section 2.3.
Where a Carrier or Shipper submits personal information about a Sub-User, that party is responsible for having informed the Sub-User and obtained all required consents.
4. How We Use Your Information
We use personal information for the following purposes:
- To create, manage, and secure user accounts.
- To operate the Platform's core functions, including building Trusted Carrier networks, posting and managing orders, assigning drivers, and facilitating dispatch.
- To enable communication and connections between Carriers and Shippers.
- To improve, maintain, and develop the Platform.
- To detect, prevent, and respond to fraud, security incidents, and violations of our Terms and Conditions.
- To comply with legal and regulatory obligations.
5. Disclosure of Your Information
5.1 Between Platform Users
As an inherent function of the Platform, certain information is shared between users to enable transactions. For example, a Carrier's company profile and relevant driver and vehicle information may be visible to a Shipper within whose Trusted Carrier network the Carrier operates.
5.2 Service Providers
We may share personal information with third-party service providers, including:
- Amazon Web Services (AWS) — cloud data storage, Montreal, Canada region.
- Cloudflare — domain hosting, content delivery, and network security.
- OneSignal — push notification delivery. Infrastructure operates primarily in the United States.
5.3 Legal Requirements
We may disclose personal information where required by law, regulation, legal process, or governmental request.
5.4 Business Transfers
In the event of a merger, acquisition, or sale of assets, personal information may be transferred as part of that transaction.
5.5 We Do Not Sell Your Data
Trukren does not sell Carrier, Shipper, driver, or Sub-User personal information to third parties.
6. Data Hosting and Storage Location
Personal information is primarily stored on AWS servers in the Montreal, Canada region. Cloudflare may process limited technical information globally, and OneSignal processes notification data on servers in the United States. Where information is processed outside of Canada, it may be subject to the laws of that jurisdiction. We take reasonable steps to ensure your information remains protected in a manner consistent with this Privacy Policy.
7. Data Retention
We retain personal information for as long as an account is active and for a reasonable period thereafter as necessary to fulfil the purposes described in this Privacy Policy and to comply with legal and regulatory obligations.
Order records for previously fulfilled orders may be retained to preserve both parties' access to their respective order history, even after one party deletes their account.
8. Security
We implement reasonable administrative, technical, and physical safeguards to protect personal information, including encryption of passwords, access controls, and secure infrastructure. However, no method of transmission or storage is completely secure.
In the event of a security breach, we will notify affected users and relevant privacy authorities in accordance with PIPEDA and applicable legislation.
9. Your Privacy Rights
Subject to applicable law, you have the following rights:
- Access — Request a copy of the personal information we hold about you.
- Correction — Request correction of inaccurate or incomplete information.
- Withdrawal of Consent — Withdraw consent to collection, use, or disclosure, subject to legal restrictions.
- Deletion — Delete your account and request removal of personal information through Platform settings.
To exercise any of these rights, please contact us using the details in Section 14.
10. Account Deletion
Carriers and Shippers may delete their account at any time through the Platform settings. Upon deletion, the company profile and Sub-User details will be removed from active visibility on the Platform, subject to the order history retention described in Section 7.
11. Third-Party Links and Services
The Platform may contain links to third-party websites or services. This Privacy Policy does not apply to those third-party services. We encourage you to review the privacy policies of any third-party services you use.
12. Children's Privacy
The Platform is intended for businesses and individuals who are at least 18 years of age. We do not knowingly collect personal information from anyone under 18. If we become aware that we have done so, we will take steps to delete it.
13. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When material changes are made, we will notify users via in-app notification and update the effective date at the top of this policy.
